Steve Miano will be a panelist discussing “Walking on… Water? Wetland Regulation in the Wake of Sackett” at the ABA Section of Environment, Energy, and Resources Section (SEER)’s 53rd Spring Conference on Friday, April 5, 2024. The Supreme Court’s ruling in Sackett v. EPA may have further muddied the waters when it comes to questions of federal jurisdiction over wetlands. The decision created new questions about the scope of federal jurisdiction, the implementation of Sackett and the resulting federal rule from late 2023, and litigation pending in lower courts. Panelists will examine the current landscape of wetland regulation and protection at the federal, state and local levels and what the future might look like. They will also provide practice tools for attendees to navigate changing and unclear waters.
