A new Environmental Protection Agency (EPA) rule was designed to make it easier for states to take over permitting for construction in federally protected wetlands and waterways. However, few states are expected to take advantage of it. Shareholder Steven Miano spoke with Bloomberg Law about some of the complications surrounding the rule, including high costs and expected scrutiny from the incoming Trump administration.

Steve stated, “It is unlikely that the new rule will inspire more states to assume control of the permitting program.” Steve also noted that “taking over the permitting program is costly, and with fewer wetlands to regulate after Sackett, states will have less funding to work with to establish, staff, and pay for a permitting program.”
