On Wednesday, July 10, 2024 Hangley Aronchick will host a CLE program “The Future of Restrictive Covenants: Navigating Uncertainties in the Law.”

Restrictive covenants, a stalwart protection for employers across industries, have become increasing unpopular in recent years. As a result, state and federal legislators and regulatory authorities are more heavily scrutinizing such covenants, particularly those that restrict employees from competing with their former employers. Most recently, the Federal Trade Commission published a final rule in May 2024 that, if it goes into effect, would effectively ban non-compete agreements between employers and employees nationwide. Although the FTC’s rule is already being challenged in court, employers must navigate the uncertainties involving the future of restrictive covenants. In this one-hour presentation, shareholders Michele Fenkel and Jason Levine will provide an overview of different types of restrictive covenants and why they are important for employers; summarize the legal landscape, including the FTC rule; and discuss key considerations for employers if certain types of restrictive covenants are invalidated.
